Is there something that exists between "fiction" and "nonfiction," where authors are allowed to make up their own facts?

Yes, political parties do it all the time, as do Creationists and the executives of big corporations. It's getting people to believe them that's the tricky bit.

Metafiction - James Ellroy American Underworld trilogy, Cormac's Blood Meridian, so forth. Fascinating article.
